Every single argument Batman uses to rationalise NOT killing the Joker is fallacious.

No, he can't, for both out-of-universe and in-universe reasons. Out-of-universe: DC writers would never make the Joker permanently good; he will always return to his evil self.
In-universe: The Joker is insane, and his evil is part of his ideology. You can't reason with him because he is beyond reasoning.

So, killing a person who has killed and tortured countless innocents is equally as evil as said person? Interesting...
